1. Agreement to Terms

Welcome to Smash King Burgers. These Terms of Service ("Terms") govern your use of our website at smashkingburgers.com and our online ordering services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We are a restaurant located in Windsor, Ontario, Canada, and these Terms are governed by Ontario and Canadian law.

2. Online Ordering Services

2.1 Order Placement

When you place an order through our website, you are making an offer to purchase food items. Your order is confirmed once you receive an order confirmation and payment is successfully processed.

2.2 Pricing and Payment

• All prices are displayed in Canadian dollars (CAD) and include applicable taxes (13% HST)
• Prices are subject to change without notice
• Payment is processed securely through Clover payment systems
• You agree to pay all charges at the prices in effect when incurred

2.3 Order Accuracy

You are responsible for ensuring the accuracy of your order, including any special instructions or dietary requirements. Please review your order carefully before submitting.

2.4 Order Cancellation

Once an order is submitted and confirmed, it cannot be cancelled as food preparation begins immediately. If you need to modify or cancel an order, please contact us immediately at +1 (226) 526-0080. Refunds for cancelled orders are at our sole discretion.

3. Pickup and Delivery

3.1 Pickup Orders

For pickup orders, you must collect your order at our restaurant location within the estimated pickup time. Orders not collected within 30 minutes of the pickup time may be discarded without refund.

3.2 Delivery Orders

• Delivery is available within our service area in Windsor, Ontario and surrounding areas
• Delivery fees are calculated based on distance and displayed at checkout
• Delivery times are estimates and may vary due to weather, traffic, or order volume
• You must provide accurate delivery address and be available to receive the order
• We are not responsible for orders delivered to incorrect addresses provided by you

4. Food Allergens and Dietary Information

Our food is prepared in a kitchen that handles common allergens including but not limited to: wheat, dairy, eggs, nuts, soy, and sesame. Cross-contamination may occur.

If you have food allergies or dietary restrictions, please contact us directly before ordering.

While we take precautions, we cannot guarantee that any menu item is completely free of allergens. You assume all risk associated with food allergies when ordering from us.

5. Halal Certification

Smash King Burgers serves 100% Halal certified meat products. Our meat suppliers are Halal certified. We maintain Halal standards in our food preparation. If you have questions about our Halal practices, please contact us.

6. Refunds and Complaints

Your satisfaction is important to us. If you have an issue with your order:

• Contact us within 24 hours of receiving your order
• Provide your order number and description of the issue
• Refunds or replacements are provided at our discretion based on the nature of the complaint
• Refunds will be processed to the original payment method

7. Website Use

7.1 Acceptable Use

You agree not to:

• Use our website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the website
• Place fraudulent orders or use stolen payment information
